General conditions of sale

Art. 1 Definitions

The following General Conditions of Sales relate to online purchases of products made by Fili di Poesia by Daniela Corti, P.I. 09798610961, pec, hereafter referred to as FdP.

Client / Customer: the party who places an order via email and social media, accepting the general conditions of sale present on the website 

Personalised product: product made-to-order, entirely customised according to the client’s wishes, and any piece modified to satisfy the client’s demands. 

Ready-to-ship product: product made by FdP, not customised in any way and therefore ready to be sent as it is to the client.

Art. 2 Characteristics of the products as presented on the website

The products sold by FdP are entirely handmade. The client is aware of this and that the images on the website are for reference only. This applies in the case of personalised products that upon the request of the client replicate products previously created by FdP. Given their nature (handmade, artisanal creations), the products may present slight changes and details may differ from the images shown on the website.  

Art. 3 Accepting the General Conditions of Sale

The client confirms that they are aware and they accept the conditions of sale presented in this document at the time of confirmation of order, whether this takes place on social media or via email.

Art. 4 Accepting orders

Orders of FdP products must be confirmed via email at the following address: The email must include the type of product, quantity, price, and delivery information. 

An order is to be considered accepted by FdP once the latter sends an email of confirmation of order. This email will contain the overview of the products that have been ordered, the price, and delivery information. 

The client must then proceed with the payment in full in case of orders for less than 300€. In case of orders over 300€, the client must pay a deposit equal to 50% of the full price. The payment of the remaining 50% is due 30 days before the date of shipping. If the client demands their order to be shipped within 30 days, they must pay the full price in one rate.

Payment for personalised products must be completed within 48 hours after receiving the confirmation of order email by FdP.
Payment for ready-to-ship products must be completed within 24 hours of receiving the confirmation of order email by FdP. In the event of delayed payment, FdP cannot guarantee the availability of the product(s) in question.

Once payment has been received by FdP, an email confirming the payment will be sent to the client by FdP, and the contract is now binding for both parties.

Art. 5 Prices and payments

The price of every product will be communicated to the client via email or social media upon request. Taxes are included in the price unless otherwise stated. The validity of each quotation will be determined on a case-by-case basis, depending on the request of the client. FdP will state the validity of each quotation clearly.

Once the client receives the email stating that FdP accepts the order, they will need to pay the full price upfront if the amount is less than 300€. The client will pay 50% of the total amount if the price is higher than 300€, and provide an invoice to confirm the payment has been made.
In the case of payments in two instalments, the remaining 50% of the total amount has to be paid within 30 days of the agreed-upon shipping date, as stated in the confirmation of order. FdP will require an invoice of the payment in order to proceed with shipping.

Art. 6 Shipping and delivery terms and conditions

The confirmation of order will detail the shipping and delivery costs and method. 

FdP will proceed with shipping only after having verified the payment as detailed in Art. 4 and 5.

FdP is not responsible for any delays in shipping and/or delivery due to a failure to complete the payment on time. 

FdP is not responsible for any delays in shipping and/or delivery, including carrier delays and force majeure. 

Custom fees may apply to international orders, and they are borne by the client. If the client refuses to pay custom tax, and the order is returned to FdP, the cost of shipping will not be refunded and it will not be possible to return the product. If the product is returned in the original condition, and if the product in question is not a personalised or customised object, the client may request a refund of the order, excluding shipping costs. If the product is in any way personalised or customised, FdP will not accept refunds , as detailed in Art. 10.

Art. 7 Transport and courier delivery

The confirmation of order will detail the shipping and delivery costs and method.  FdP will proceed with shipping only after having verified the payment as detailed in Art. 4 and 5.

The following information is required to proceed with shipping: complete address, including ZIP code and telephone number for tracked shipping. US customers will need to provide a SSN. FdP uses the following services: SDA Poste Italiane, UPS, DHL, TNT, BRT, depending on the best rate and geographical location.

Shipping costs vary depending on the quantity, weight, and volume of the order. The cost of shipping will be clearly detailed in the confirmation of order.

FdP ensures that each order is packaged in a suitable manner, and does everything to ensure the order is protected from damage. However, FdP is not responsible for any damages or losses, as they are entirely the responsibility of the courier.

The courier will attempt to deliver the order twice. If any issues arise, the client should contact the courier directly and follow their instructions. Any additional shipping costs due to courier delays or losses are to be borne by the client.

Art. 8 Payment methods

FdP accepts the following payment methods: (i) bank transfer, (ii) Paypal money transfer, (iii) Credit Card via Paypal circuit.

Art. 9 Product warranty and complaints

(i) Personalised and customised products
FdP commits to sending a photo of the order before it is finalised: small changes and alterations can still be made at this stage, upon request of the client. Once the changes have been made, additional alterations are not allowed. If the client requests additional changes, FdP may agree to them for a fee, which will be clearly and promptly communicated to the client before taking action.
Per Italian legislation, refunds and returns do not apply to personalised and customised products.

(ii)Ready-to-ship products
Per Italian legislation, the client has 30 days to request a refund or return an order. The request needs to be sent to the following address:
FdP will only proceed with a refund or return if the item is sent back in the original conditions and in the original packaging. The cost of shipping for returned items is to be borne by the client.

Art. 10 Right of withdrawal

The client has the right to return any order provided it does not contain any personalised or customised product, as stated in Art. 9.

The client must request a return within 30 days of receiving the product via email at
FdP will only accept returns if the conditions detailed in Art. 9 are satisfied. If a refund is applicable, FdP will proceed within 15 days of receiving the order in question. The refund will be processed through the same means of payment that the client has chosen at the time of the order.

As detailed in Art 9, the right of withdrawal does not apply to personalised products, or products that were altered in any way on request of the client. This right only applies to ready-to-ship products that were not altered in any way. 

Art. 11 Privacy 

The customer is informed that:
The customer's personal data will be processed for (i) purposes functional to the fulfilment of tax, accounting and legal obligations and for the purposes of managing contracts and customers (product and accessory supply, assistance service, replacement, repair, customer management and administration, orders, shipments, invoices, solvency control and litigation management) and for (ii) purposes related to commercial activity (mail order, marketing and advertising, market analysis and surveys, promotional activities, customer satisfaction survey, competitions, statistical analysis).

The data will be processed, through the creation and management of a central archive, on paper, and through computer and telematic support to which specialised and authorised personnel have access. The provision of personal data essential for legal obligations and / or the establishment and / or continuation of the contractual relationship is mandatory, in the sense that in the absence it will be impossible to establish and / or give effect to this relationship. The provision of other personal data is optional and generally functional to provide a better service to customers; Any refusal to provide such data will not have negative consequences for the client.

Personal data concerning the customer may be communicated to parent companies, subsidiaries and / or affiliates of FdP for the same purposes mentioned above or to external parties of services specialised in: (i) management of software, hardware, telematic and information systems; ii) data processing and archiving activities; (iii) printing, transmitting, enveloping, transporting and sorting communications to customers; (iv) financing, debt collection and financial risk detection services.

Art 7 of the Privacy Code always applies.

The customer, by sending the confirmation of his purchase order electronically, takes note of the above information and consents to the processing of personal data provided.

Art. 12 Place of jurisdiction 

Any dispute relating to the application, execution, interpretation and violation of purchase contracts governed by these general conditions of sale, is subject to Italian jurisdiction.

For matters not covered by these general conditions of sale, the Civil Code and Consumer Code apply, unless otherwise stated.
